Partnership Terms and Conditions

  1. Definitions
    In these Terms and Conditions:
    • Drive Queensland means Fionnghal Pty Ltd Trading as Drive Queensland AU.
    • Partner means the organisation or individual approved by Drive Queensland to participate in a partnership.
    • Partnership means the agreed partnership level and inclusions outlined in the Drive Queensland Partnership Prospectus 2026 and the approved Partnership Application Form.
    • Term means the 12-month period commencing from the date of partnership approval unless otherwise agreed in writing.
  2. Partnership Application and Approval
    1. All partnership applications are subject to approval by Drive Queensland at its sole discretion.
    2. Submission of a Partnership Application Form does not guarantee acceptance.
    3. Drive Queensland reserves the right to decline any application without providing reasons.
  3. Partnership Term
    1. Partnerships are valid for a period of twelve (12) months from the date of approval.
    2. Partnerships are non-transferable without prior written consent from Drive Queensland.
  4. Fees and Payment
    1. All partnership fees are quoted exclusive of GST unless stated otherwise.
    2. Upon approval, an invoice will be issued and payment is required within seven (7) days of the invoice date.
    3. Failure to pay within the required timeframe may result in suspension or cancellation of partnership benefits.
    4. Partnership fees are non-refundable, including in circumstances where the Partner does not utilise all benefits.
  5. Partner Obligations
    1. The Partner agrees to provide accurate, current, and lawful information for use across Drive Queensland platforms.
    2. All content supplied by the Partner (including text, images, video and logos) must be owned by the Partner or used with appropriate permissions.
    3. The Partner warrants that supplied content does not infringe any third-party rights or breach any laws or regulations.
    4. The Partner agrees to conduct their business in a professional manner that does not bring Drive Queensland or Queensland tourism into disrepute.
    5. The person entering into the Partnership agreement must be duly authorised to act on behalf of the organisation or business represented.
  6. Drive Queensland Obligations
    1. Drive Queensland will provide partnership inclusions in accordance with the selected partnership level, subject to availability and scheduling.
    2. Promotional opportunities, exposure quantities, and timelines are indicative only and may vary due to operational requirements. 6.3 Minimum guaranteed exposure applies only where expressly stated.
  7. Use of Branding and Intellectual Property
    1. Drive Queensland grants the Partner a non-exclusive, non-transferable licence to use the Drive Queensland partner logo for the duration of the Term.
    2. The Partner must comply with Drive Queensland brand guidelines when using logos or brand assets.
    3. All intellectual property rights in Drive Queensland materials remain the property of Drive Queensland.
    4. Drive Queensland may use the Partner’s name, logo and supplied content for promotional and marketing purposes during the Term.
  8. Content, Editorial and Approvals
    1. All editorial content, social media posts, blogs and promotional materials are subject to Drive Queensland’s editorial standards and approval.
    2. Drive Queensland reserves the right to edit, decline or remove content that does not align with brand values or quality standards.
    3. Content and supply deadlines must be met to ensure inclusion in scheduled campaigns.
  9. Advertising and Additional Opportunities
    1. Discounts for advertising in the Drive Queensland Map and Drive Guide apply as outlined in the Partnership Prospectus and are subject to conditions.
    2. Advertising placements are subject to availability and separate booking deadlines.
    3. Participation in competitions, campaigns, podcasts, shows or additional marketing initiatives may incur extra costs.
  10. Events, Shows and Activations
    1. Attendance at consumer or trade shows is subject to availability, venue capacity and operational requirements.
    2. Drive Queensland reserves the right to amend show schedules, locations or inclusions.
    3. Costs associated with travel, accommodation, staffing and collateral for events are the responsibility of the Partner unless otherwise agreed.
  11. Reporting and Insights
    1. Reporting provided by Drive Queensland is indicative only and based on available data.
    2. Drive Queensland does not guarantee specific performance outcomes, reach, engagement or conversion results.
  12. Sustainability Initiative
    1. Drive Queensland will arrange the planting of one (1) tree on behalf of each Partner as outlined in the Partnership Prospectus.
    2. Tree planting locations are subject to availability and program requirements.
  13. Cancellation and Termination
    1. The Partner may not terminate the Partnership for convenience once approved.
    2. Drive Queensland may terminate the Partnership immediately if the Partner:
      • breaches these Terms and Conditions;
      • engages in conduct that may damage Drive Queensland’s reputation; or
      • fails to make payment in accordance with these Terms.
    3. No refunds will be provided upon termination.
  14. Limitation of Liability
    1. To the maximum extent permitted by law, Drive Queensland is not liable for any indirect, consequential or economic loss arising from the Partnership.
    2. Drive Queensland’s total liability is limited to the partnership fees paid by the Partner for the relevant Term.
  15. Indemnity
    The Partner indemnifies Drive Queensland against any claims, losses, damages or expenses arising from:
    1. supplied content;
    2. breach of these Terms; or
    3. the Partner’s business operations.
  16. Privacy
    1. Drive Queensland will handle personal information in accordance with applicable Australian privacy laws.
    2. Partner contact details may be used for partnership administration and communications.
  17. Force Majeure
    Drive Queensland is not liable for failure or delay in performance due to events beyond its reasonable control, including natural disasters, pandemics, government restrictions or event cancellations.
  18. Amendments
    Drive Queensland reserves the right to update these Terms and Conditions. Updated terms will apply to new and renewing partnerships.
  19. Governing Law
    These Terms and Conditions are governed by the laws of Queensland, Australia, and the parties submit to the exclusive jurisdiction of Queensland courts.

By submitting a Partnership Application Form and upon approval, the Partner agrees to be bound by these Terms and Conditions.
